• All artwork displayed on our website is subject to prior sale and availability
• Prices are listed in USD and may change without prior notice
• We reserve the right to refuse or cancel any order at our discretion
• Colors and details may vary slightly from on-screen representation due to monitor calibration and photography
• Product descriptions are provided to the best of our knowledge but are not warranted to be complete or error-free

All payments are processed securely through Stripe. We accept major credit cards, debit cards, and Apple Pay. By placing an order, you represent that you are authorized to use the payment method provided. Sales tax is applied where required by law.

If you create an account on our website, you are responsible for maintaining the confidentiality of your credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use. We reserve the right to terminate accounts at our discretion.

Consignment of artwork with Austin Gallery is governed by a separate Consignment Agreement executed between the consignor and Austin Gallery. These Terms of Service apply to website usage and purchases, not to consignment relationships. Please visit our Consignment page for details on selling your art.

Austin Gallery facilitates a charitable art donation program in partnership with verified 501(c)(3) charities. Under this program, donors transfer artwork directly to a partner charity, which then consigns the art to Austin Gallery for sale.

• Austin Gallery does not provide tax, legal, or accounting advice in connection with the charitable giving program or otherwise
• Tax deductions depend on individual circumstances and are subject to IRS rules and limitations
• Qualified appraisals are performed by independent, certified third-party appraisers — Austin Gallery is not the appraiser
• Austin Gallery makes no guarantees regarding deduction amounts, sale prices, or tax outcomes
• Partner charities independently decide whether to accept donated artwork and whether to consign it through Austin Gallery

To the fullest extent permitted by law, Austin Gallery shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the website, purchase of artwork, or reliance on any information provided. Our total liability for any claim shall not exceed the amount paid for the specific artwork at issue.

You agree to indemnify and hold harmless Austin Gallery, its owners, employees, and agents from any claims, damages, losses, or expenses arising from your use of the website or violation of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts located in Travis County, Texas.

We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated revision date. Your continued use of the website after any changes constitutes acceptance of the revised Terms.
